1. Acceptance of Terms

Welcome to HEKA Calendar ("we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of the HEKA Calendar mobile application, website, and related services (collectively, the "Service").

By downloading, installing, or using HEKA Calendar, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

                        Important: You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use HEKA Calendar. By using the Service, you represent that you meet this requirement.
                    

2. Description of Service

HEKA Calendar is a calendar and timekeeping application that provides:

Calendar Functionality: A 13-month calendar system with note-taking and organization features
Astrological Features: Birth charts, planetary positions, transits, and astrological interpretations (the "Astrology Services")
Journal System: Personal diary and reflection tools with optional celestial context
Optional Cloud Sync: Cross-device synchronization via Firebase (requires account creation)
Enterprise SSO: Organization login via SAML 2.0 or OIDC identity providers
AI Coaching: Optional LLM-enhanced insights routed through the HEKA AI Proxy

For Entertainment and Reflection Only. The astrological features, birth charts, transit interpretations, and celestial guidance provided by HEKA Calendar are for entertainment, self-reflection, and educational purposes only.

They do not constitute:

Professional astrological advice
Medical, psychological, or therapeutic guidance
Legal, financial, or career counseling
Predictions of certainty

You assume full responsibility for any actions taken based on astrological information provided by the Service.

3. User Accounts

3.1 Account Creation

You may use HEKA Calendar without creating an account. An account is only required for:

Cloud sync across devices
Data backup and recovery
Accessing premium or enterprise features
Using social features such as Cosmic Circle

3.2 Account Security

You are responsible for:

Maintaining the confidentiality of your account credentials
All activities that occur under your account
Notifying us immediately of any unauthorized access

3.3 Account Termination

We reserve the right to suspend or terminate accounts that:

Violate these Terms
Engage in fraudulent or abusive behavior
Infringe on intellectual property rights

You may delete your account at any time through the app settings. Deletion triggers our server-side deleteUserData function, which removes cloud data and writes an immutable audit log. Local data on your devices remains under your control.

4. Enterprise SSO

If your organization enables HEKA Calendar for enterprise use, you may sign in through your organization’s SAML 2.0 or OIDC identity provider.

HEKA Calendar receives only the information your identity provider shares (typically email, name, and organization membership).
Your organization’s IT administrator may control access, suspend accounts, or request data deletion.
Enterprise users are subject to their organization’s policies in addition to these Terms.

5. Social Features & Community Guidelines

5.1 Cosmic Circle & Friend Connections

HEKA Calendar offers optional social features including:

Cosmic Circle: Connect with friends via invite codes to share celestial moments and support
Task Sharing: Share task rituals with other users via unique, time-limited invite links
Community Voting: Participate in anonymous voting for community holidays and feature preferences

5.2 Community Guidelines

By using social features, you agree to:

Only connect with people you know or who have shared an invite code with you
Not use the service to harass, bully, threaten, or spam others
Not share illegal, harmful, offensive, or discriminatory content
Not impersonate others or misrepresent your identity
Respect the privacy of your connections

We reserve the right to suspend or terminate access to social features for violations of these guidelines.

5.3 Profile Content

You are responsible for your profile information (display name, avatar) and any content you share in messages or tasks. Shared task links expire after 7 days and can only be accepted once.

6. User Conduct

6.1 Acceptable Use

You agree to use HEKA Calendar only for lawful purposes and in accordance with these Terms. You agree not to:

Use the Service in any way that violates applicable laws or regulations
Attempt to gain unauthorized access to the Service or its systems
Interfere with or disrupt the integrity or performance of the Service
Reverse engineer, decompile, or disassemble any part of the Service
Use the Service to generate or distribute harmful, threatening, or discriminatory content
Impersonate another person or misrepresent your identity

6.2 AI Features (Optional)

HEKA Calendar offers optional AI-enhanced astrological readings. By default, AI requests are routed through the HEKA AI Proxy hosted on Vercel.

                        How the proxy works:
                        The proxy verifies your Firebase identity token
It applies per-user rate limits to prevent abuse
It forwards your prompt to the selected AI provider using server-side API keys
Provider keys are stored as secure environment variables and are never exposed to the client
Sanitized audit logs are kept for abuse monitoring and rate-limiting

                    

Your responsibilities:

Using AI features in compliance with these Terms and the AI provider’s terms of service
Not attempting to bypass rate limits or abuse the proxy
Understanding that AI-generated content is provided "as is" without warranty

Bring-your-own-key option: Advanced users may connect their own API key from Groq, OpenAI, Anthropic, Moonshot, or a self-hosted Ollama instance. In that case, requests are sent directly from your device to the chosen provider, and you are responsible for that provider’s terms, costs, and key security.

                        Fallback: If no AI provider is configured, the app uses its built-in template library with thousands of pre-written readings (always free, always available).
                    

7. Intellectual Property

7.1 Our Content

HEKA Calendar and its original content, features, and functionality are owned by us and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not:

Copy, modify, or create derivative works of the Service
Distribute, sell, or sublicense the Service
Remove any copyright or proprietary notices

7.2 Your Content

You retain ownership of any content you create in HEKA Calendar, including calendar notes, journal entries, and birth chart data.

You grant us a limited license to store, display, and transmit your content solely for the purpose of operating and improving the Service.

7.3 Feedback

Any feedback, suggestions, or ideas you provide may be used by us without compensation or attribution.

8. Data and Privacy

Your use of HEKA Calendar is also governed by our Privacy Policy. By using the Service, you consent to our collection and use of information as described in the Privacy Policy.

Key privacy principles:

Local-First: Most data stays on your device by default
Server-Verified: Premium, enterprise, and deletion features are enforced by Firebase Functions
Optional Sync: Cloud features require explicit opt-in
No Data Sale: We do not sell your personal information
Export: You can export your data at any time

9. Third-Party Services

9.1 Firebase & Google Cloud

Our optional cloud sync, authentication, Cloud Functions, and Crashlytics use Firebase and Google Cloud. Your use of cloud features is subject to Google's Terms of Service.

9.2 Vercel

The HEKA AI Proxy is hosted on Vercel. Vercel processes requests only to verify identity, enforce rate limits, and forward them to AI providers. Vercel does not store your journal or birth chart data.

9.3 AI Services

If you use AI features, prompts may be processed by Groq, OpenAI, Anthropic, Moonshot, or a self-hosted Ollama instance. By using AI features, you accept the applicable provider's terms of service and privacy policy.

9.4 App Stores

Your download and use of HEKA Calendar through app stores (Apple App Store, Google Play Store) is subject to those platforms' terms and conditions.

10. Disclaimers

10.1 "As Is" Disclaimer

HEKA Calendar is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, expressed or implied, including but not limited to:

Accuracy: We do not guarantee the accuracy of astrological calculations or interpretations
Availability: We do not guarantee uninterrupted access to the Service
Results: We do not guarantee any specific outcomes from using the Service

10.2 Astrology-Specific Disclaimer

Astrology is not scientifically proven. Celestial events and planetary positions should not be used as a substitute for professional advice in medical, legal, financial, or psychological matters. Always consult qualified professionals for such advice.

10.3 Beta Features

Some features may be labeled as "beta" or "experimental." These features are provided for testing purposes and may contain bugs or be discontinued at any time.

11. Limitation of Liability

To the maximum extent permitted by law:

We shall not be liable for any indirect, incidental, special, consequential, or punitive damages
Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim (or $100 USD if you used the free version)
We are not responsible for:
- Loss of data due to device failure or user error
- Inaccuracies in astrological interpretations
- Third-party service outages (Firebase, Vercel, AI services)
- Actions taken based on astrological guidance

12. Indemnification

You agree to defend, indemnify, and hold harmless HEKA Calendar and its operators from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or in any way connected with:

Your use of the Service
Your violation of these Terms
Your violation of any third-party rights
Any content you submit to the Service

13. Termination

13.1 By You

You may stop using HEKA Calendar at any time. To delete your account and cloud data, use the in-app settings or contact us.

13.2 By Us

We may suspend or terminate your access to the Service immediately, without prior notice or liability, for any reason, including breach of these Terms.

13.3 Effect of Termination

Upon termination:

Your right to use the Service immediately ceases
Cloud data may be deleted after a reasonable grace period
Local data on your devices remains under your control
Provisions that by their nature should survive termination shall survive

14. Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting the revised Terms.

Material changes will be notified through:

In-app notification
Email to registered users (if applicable)
Update to the "Last Updated" date

Your continued use of the Service after changes constitutes acceptance of the new Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of New South Wales, Australia, without regard to its conflict of law provisions.

Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts of New South Wales, Australia.

16. Dispute Resolution

16.1 Informal Resolution

Before filing a claim, you agree to try to resolve disputes informally by contacting us at hekacalendar@gmail.com. We'll attempt to resolve the dispute within 30 days.

16.2 Arbitration

If informal resolution fails, any dispute shall be resolved through binding arbitration (not court proceedings) in accordance with the rules of the Australian Centre for International Commercial Arbitration (ACICA).

Class Action Waiver: You agree that any proceedings will be conducted only on an individual basis and not as a class action, consolidated action, or representative action.

16.3 Exceptions

Either party may bring suit in court to:

Enforce intellectual property rights
Seek emergency injunctive relief

17. Severability

If any provision of these Terms is held to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and HEKA Calendar regarding the Service, superseding any prior agreements.

20.1 Apple App Store

If you downloaded HEKA Calendar from the Apple App Store:

These Terms are between you and HEKA Calendar, not Apple
Apple has no obligation to furnish any maintenance or support services
Apple is not responsible for addressing any claims related to the app
Apple is a third-party beneficiary of these Terms

20.2 Google Play Store

If you downloaded HEKA Calendar from the Google Play Store:

These Terms are between you and HEKA Calendar, not Google
Google is not responsible for the app or its content
